住房城鄉建設部關于加強和改善工程造(zao)價監管的意見 建標〔2017〕209
各省(sheng)、自治區住房城鄉建設廳(ting),直轄(xia)市建委,國務院有(you)關部門:
工程造價監管是建設市場監管的重要內容,加強和改善工程造價監管是維護市場公平競爭、規范市場秩序的重要保障。近年來,工程造價監管在推進建筑業“放管服”改革,堅持市場決定工程造價,完善工程計價制度,維護建設市場各方合法權益等方面取得明顯成效,但也存在工程造價咨詢服務信用體系不健全、計價體系不完善、計價行為不規范、計價監督機制不完善等問題。為貫徹落實《國務院關于印發“十三五”市場監管規劃的通知》(國發〔2017〕6號)和《國務院辦公廳關于促進建筑業持續健康發展的意見》(國辦發〔2017〕19號),完善工程造價監管機制,全面提升工程造價監管水平,更好服務建筑業持續健康發展,現提出以下意見:
一、深化工(gong)程造(zao)價咨(zi)詢(xun)業監管改革(ge),營(ying)造(zao)良好市場環境
(一(yi))優化(hua)資質資格管理(li)。
進一步簡化工(gong)(gong)程造(zao)(zao)價(jia)咨(zi)詢(xun)企(qi)業資(zi)質(zhi)管(guan)理,全面實行行政許可事項網上(shang)辦理,提(ti)高行政審批效率(lv),逐步取(qu)消工(gong)(gong)程造(zao)(zao)價(jia)咨(zi)詢(xun)企(qi)業異(yi)地執業備案(an),減輕企(qi)業負擔。完善(shan)造(zao)(zao)價(jia)工(gong)(gong)程師(shi)執業資(zi)格制度,發揮個人執業在工(gong)(gong)程造(zao)(zao)價(jia)咨(zi)詢(xun)中(zhong)的作用(yong)。推(tui)進造(zao)(zao)價(jia)工(gong)(gong)程師(shi)執業資(zi)格國際互認,為(wei)“一帶一路(lu)”國家戰略和工(gong)(gong)程造(zao)(zao)價(jia)咨(zi)詢(xun)企(qi)業“走出去(qu)”提(ti)供(gong)人才支撐(cheng)。
(二)建(jian)立以(yi)信用為核心的新型市場監管(guan)機制。
各級(ji)住房(fang)城鄉建(jian)(jian)設主(zhu)管(guan)(guan)部(bu)門、有關(guan)行(xing)業主(zhu)管(guan)(guan)部(bu)門要按照(zhao)“誰(shui)(shui)(shui)審批、誰(shui)(shui)(shui)監(jian)(jian)管(guan)(guan),誰(shui)(shui)(shui)主(zhu)管(guan)(guan)、誰(shui)(shui)(shui)監(jian)(jian)管(guan)(guan)”和(he)(he)信(xin)(xin)(xin)(xin)用(yong)(yong)信(xin)(xin)(xin)(xin)息“誰(shui)(shui)(shui)產(chan)生(sheng)、誰(shui)(shui)(shui)負責(ze)(ze)、誰(shui)(shui)(shui)歸(gui)集、誰(shui)(shui)(shui)解釋”的原則,加快(kuai)推(tui)進(jin)工(gong)(gong)程(cheng)造(zao)價咨詢信(xin)(xin)(xin)(xin)用(yong)(yong)體系(xi)建(jian)(jian)設。積極(ji)推(tui)進(jin)工(gong)(gong)程(cheng)造(zao)價咨詢企(qi)(qi)業年報公(gong)示和(he)(he)信(xin)(xin)(xin)(xin)用(yong)(yong)承諾制(zhi)度,加快(kuai)信(xin)(xin)(xin)(xin)用(yong)(yong)檔(dang)案建(jian)(jian)設,增強(qiang)企(qi)(qi)業責(ze)(ze)任(ren)意識(shi)、信(xin)(xin)(xin)(xin)用(yong)(yong)意識(shi)。加快(kuai)政府部(bu)門之間工(gong)(gong)程(cheng)造(zao)價信(xin)(xin)(xin)(xin)用(yong)(yong)信(xin)(xin)(xin)(xin)息共建(jian)(jian)共享,強(qiang)化行(xing)業協會自(zi)律和(he)(he)社會監(jian)(jian)督作用(yong)(yong),應用(yong)(yong)投訴舉(ju)報方式,建(jian)(jian)立工(gong)(gong)程(cheng)造(zao)價咨詢企(qi)(qi)業和(he)(he)造(zao)價工(gong)(gong)程(cheng)師守(shou)信(xin)(xin)(xin)(xin)聯合激勵和(he)(he)失(shi)信(xin)(xin)(xin)(xin)聯合懲戒機制(zhi),重點(dian)監(jian)(jian)管(guan)(guan)失(shi)信(xin)(xin)(xin)(xin)企(qi)(qi)業和(he)(he)執業人員,積極(ji)推(tui)進(jin)信(xin)(xin)(xin)(xin)用(yong)(yong)信(xin)(xin)(xin)(xin)息和(he)(he)信(xin)(xin)(xin)(xin)用(yong)(yong)產(chan)品應用(yong)(yong)。
(三)營造良好的工程造價咨(zi)詢業發展環境。
充分發揮工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)造(zao)價(jia)(jia)在(zai)工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)建設全(quan)過(guo)程(cheng)(cheng)(cheng)(cheng)(cheng)管理中的引導作用,積極培育具有全(quan)過(guo)程(cheng)(cheng)(cheng)(cheng)(cheng)工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)咨(zi)詢(xun)(xun)(xun)能力的工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)造(zao)價(jia)(jia)咨(zi)詢(xun)(xun)(xun)企業,鼓勵工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)造(zao)價(jia)(jia)咨(zi)詢(xun)(xun)(xun)企業融合投資咨(zi)詢(xun)(xun)(xun)、勘(kan)察、設計、監理、招標代理等(deng)業務開(kai)展聯合經營,開(kai)展全(quan)過(guo)程(cheng)(cheng)(cheng)(cheng)(cheng)工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)咨(zi)詢(xun)(xun)(xun),設立(li)合伙制(zhi)工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)造(zao)價(jia)(jia)咨(zi)詢(xun)(xun)(xun)企業。促進企業創新發展,強(qiang)化(hua)工(gong)(gong)程(cheng)(cheng)(cheng)(cheng)(cheng)造(zao)價(jia)(jia)咨(zi)詢(xun)(xun)(xun)成果質量終身責任制(zhi),逐步建立(li)執業人員保(bao)險(xian)制(zhi)度(du)。
(四)
完善工(gong)(gong)程(cheng)(cheng)造(zao)(zao)價(jia)咨(zi)詢(xun)企(qi)業退出機制。對長期(qi)未履行年報義務,長期(qi)無咨(zi)詢(xun)業務,以及違反相關政策(ce)法規、計價(jia)規則等不(bu)正當(dang)競爭行為的工(gong)(gong)程(cheng)(cheng)造(zao)(zao)價(jia)咨(zi)詢(xun)企(qi)業和造(zao)(zao)價(jia)工(gong)(gong)程(cheng)(cheng)師記(ji)入信(xin)用檔案(an),情節嚴重的,依法強制退出市場(chang)。嚴肅查處工(gong)(gong)程(cheng)(cheng)造(zao)(zao)價(jia)咨(zi)詢(xun)企(qi)業資質“掛靠”、造(zao)(zao)價(jia)工(gong)(gong)程(cheng)(cheng)師違規“掛證(zheng)”行為。
二、共(gong)編共(gong)享計(ji)價(jia)依據,搭建公平(ping)市場平(ping)臺
(一(yi))完善工(gong)程建設全過程計價依據(ju)體系。
完善(shan)工(gong)程前(qian)期投(tou)資估(gu)算、設計概算等(deng)計價(jia)依據(ju),清除(chu)妨(fang)礙形(xing)成全(quan)國統(tong)(tong)一(yi)市場的(de)不合(he)理地區(qu)計價(jia)依據(ju),統(tong)(tong)一(yi)消(xiao)耗量定(ding)額編(bian)制規則,推動形(xing)成統(tong)(tong)一(yi)開(kai)放(fang)的(de)建設市場。加(jia)快編(bian)制工(gong)程總(zong)承(cheng)包計價(jia)規范,規范工(gong)程總(zong)承(cheng)包計量和計價(jia)活(huo)動。統(tong)(tong)一(yi)工(gong)程造價(jia)綜(zong)合(he)指標指數和人工(gong)、材(cai)料(liao)價(jia)格(ge)信息發布標準。
(二)大力(li)推進共(gong)享計價依據編制。
整合各地、各有關部門計價(jia)依(yi)據編制力量,共(gong)編共(gong)享計價(jia)依(yi)據,并(bing)及時修訂,提高(gao)其時效(xiao)性(xing)。各級工程造(zao)價(jia)管(guan)理機構要完善本地區(qu)、本行(xing)業人工、材料(liao)、機械價(jia)格信(xin)(xin)(xin)息(xi)發布機制,探索區(qu)域(yu)價(jia)格信(xin)(xin)(xin)息(xi)統(tong)一(yi)(yi)測算、統(tong)一(yi)(yi)管(guan)理、統(tong)一(yi)(yi)發布模(mo)式,提高(gao)信(xin)(xin)(xin)息(xi)發布的及時性(xing)和準確性(xing),為工程項目(mu)全過程投資控制和工程造(zao)價(jia)監管(guan)提供支(zhi)撐。
(三(san))突(tu)出服務重(zhong)點領(ling)域的造價(jia)指標編(bian)制。
為(wei)推進工(gong)程科(ke)學決策和造(zao)價控制(zhi)提供依據,圍繞政府投資工(gong)程,編制(zhi)對本行業、本地區具(ju)有重大影響的工(gong)程造(zao)價指標。加快住房城鄉建設領域(yu)裝(zhuang)配式建筑、綠色(se)建筑、城市(shi)軌道交(jiao)通、海綿城市(shi)、城市(shi)地下綜合(he)管(guan)廊等工(gong)程造(zao)價指標編制(zhi)。
(四)完善建設工程人工單價(jia)市場形成機制。
改(gai)革計價依據中人工(gong)(gong)(gong)單價的(de)計算方(fang)法,使其更(geng)加貼近市場(chang),滿(man)足市場(chang)實際需要。擴大人工(gong)(gong)(gong)單價計算口徑,將單價構成調(diao)整(zheng)為工(gong)(gong)(gong)資、津貼、職工(gong)(gong)(gong)福(fu)利費(fei)(fei)、勞動(dong)保(bao)(bao)護費(fei)(fei)、社會(hui)保(bao)(bao)險費(fei)(fei)、住(zhu)房公積(ji)金、工(gong)(gong)(gong)會(hui)經費(fei)(fei)、職工(gong)(gong)(gong)教育(yu)經費(fei)(fei)以及特殊情況(kuang)下(xia)工(gong)(gong)(gong)資性(xing)費(fei)(fei)用,并(bing)依據新材(cai)料、新技術(shu)的(de)發展(zhan),及時調(diao)整(zheng)人工(gong)(gong)(gong)消耗量。各(ge)省級建(jian)設主管(guan)部(bu)門、有關(guan)行(xing)業(ye)主管(guan)部(bu)門工(gong)(gong)(gong)程造價管(guan)理機構要深入市場(chang)調(diao)查,按(an)上述口徑建(jian)立(li)人工(gong)(gong)(gong)單價信息動(dong)態(tai)發布機制(zhi),引導(dao)企業(ye)將工(gong)(gong)(gong)資分配向關(guan)鍵(jian)技術(shu)技能崗位傾斜,定期(qi)集中發布人工(gong)(gong)(gong)單價信息。
三、明確工(gong)程質量(liang)安全措施(shi)費用(yong),突出服務市(shi)場(chang)關鍵環節(jie)
(一)落實安(an)全文明(ming)施工、綠色施工等措施費。
各(ge)級住房城鄉建(jian)設主(zhu)管部(bu)門要以保(bao)障工程(cheng)質量安全、創建(jian)綠(lv)色環(huan)保(bao)施工環(huan)境為目標,不(bu)斷完(wan)善(shan)工程(cheng)計價依據中綠(lv)色建(jian)筑(zhu)、裝(zhuang)配式建(jian)筑(zhu)、環(huan)境保(bao)護、安全文明(ming)施工等有關措施費用(yong),并加強(qiang)對(dui)費用(yong)落實情(qing)況的監督(du)。
(二)合理確(que)定(ding)建設工程工期。
合理(li)確(que)定、有效控制建(jian)設(she)工(gong)(gong)程(cheng)(cheng)(cheng)工(gong)(gong)期是確(que)保(bao)(bao)工(gong)(gong)程(cheng)(cheng)(cheng)質量安全的重要(yao)(yao)內容。各(ge)級住房(fang)城鄉建(jian)設(she)主(zhu)管部門要(yao)(yao)指(zhi)導和(he)(he)監督工(gong)(gong)程(cheng)(cheng)(cheng)建(jian)設(she)各(ge)方(fang)主(zhu)體認真(zhen)貫徹(che)落實(shi)(shi)《建(jian)筑(zhu)安裝工(gong)(gong)程(cheng)(cheng)(cheng)工(gong)(gong)期定額》,在(zai)可行(xing)性研究、初步(bu)設(she)計、招標投標及(ji)簽(qian)訂合同(tong)階段應結(jie)合施工(gong)(gong)現場實(shi)(shi)際情況(kuang),科(ke)學合理(li)確(que)定工(gong)(gong)期。加(jia)大工(gong)(gong)期定額實(shi)(shi)施力度,杜絕任意壓縮合同(tong)工(gong)(gong)期行(xing)為,確(que)保(bao)(bao)工(gong)(gong)期管理(li)的各(ge)項規定和(he)(he)要(yao)(yao)求落實(shi)(shi)到(dao)位。
四、強化工程價款結算糾紛調解,營造(zao)競爭有序(xu)的(de)市場(chang)環(huan)境
(一)規范工程價款結算(suan)。
強化合同(tong)對工(gong)(gong)程(cheng)(cheng)(cheng)價(jia)(jia)款的約(yue)定與調整,推行(xing)(xing)工(gong)(gong)程(cheng)(cheng)(cheng)價(jia)(jia)款施工(gong)(gong)過(guo)程(cheng)(cheng)(cheng)結算(suan)制度,規范工(gong)(gong)程(cheng)(cheng)(cheng)預付款、工(gong)(gong)程(cheng)(cheng)(cheng)進度款支(zhi)付。研究建立工(gong)(gong)程(cheng)(cheng)(cheng)價(jia)(jia)款結算(suan)文件(jian)備案(an)與產權登記聯動的信息共(gong)享機制。鼓勵采取工(gong)(gong)程(cheng)(cheng)(cheng)款支(zhi)付擔(dan)保等(deng)手段,約(yue)束建設單(dan)位履(lv)約(yue)行(xing)(xing)為(wei),確保工(gong)(gong)程(cheng)(cheng)(cheng)價(jia)(jia)款支(zhi)付。
(二)強化工(gong)程價(jia)款結算過程中農民工(gong)工(gong)資(zi)的支(zhi)付(fu)管理(li)。
為保障農民(min)工(gong)合法(fa)權益,落實(shi)人(ren)(ren)工(gong)費用與其(qi)他工(gong)程款分(fen)賬管理制度,完(wan)善農民(min)工(gong)工(gong)資(zi)(勞(lao)務(wu)費)專(zhuan)用賬戶管理,避免(mian)總承包人(ren)(ren)將經營風險轉嫁給農民(min)工(gong),克扣或拖欠農民(min)工(gong)工(gong)資(zi)。
(三)建立工程造(zao)價糾紛調解(jie)機制。
制定工(gong)程(cheng)造(zao)(zao)價(jia)(jia)鑒定標(biao)準,規(gui)范工(gong)程(cheng)造(zao)(zao)價(jia)(jia)咨詢企業(ye)、造(zao)(zao)價(jia)(jia)工(gong)程(cheng)師參與工(gong)程(cheng)造(zao)(zao)價(jia)(jia)經(jing)濟糾(jiu)紛(fen)(fen)鑒定和(he)仲(zhong)裁咨詢行為,重點(dian)加強工(gong)程(cheng)價(jia)(jia)款結算糾(jiu)紛(fen)(fen)和(he)合(he)同糾(jiu)紛(fen)(fen)的調解(jie)(jie)。積極(ji)搭建(jian)工(gong)程(cheng)造(zao)(zao)價(jia)(jia)糾(jiu)紛(fen)(fen)調解(jie)(jie)平臺(tai),充(chong)分(fen)發(fa)揮經(jing)驗豐富的造(zao)(zao)價(jia)(jia)工(gong)程(cheng)師調解(jie)(jie)糾(jiu)紛(fen)(fen)的專業(ye)優勢,提高糾(jiu)紛(fen)(fen)解(jie)(jie)決效率,維護建(jian)設市場穩定。
五、加強工程(cheng)造價制度(du)有效實施,完善市場監管手段
(一)加強政府投資工程造(zao)價(jia)服(fu)務。
各(ge)級工(gong)(gong)(gong)程(cheng)造價管理(li)機(ji)構要不(bu)斷提(ti)高政府投資(zi)工(gong)(gong)(gong)程(cheng)和重大工(gong)(gong)(gong)程(cheng)項目工(gong)(gong)(gong)程(cheng)造價服(fu)務能力,建立工(gong)(gong)(gong)程(cheng)造價全過程(cheng)信息服(fu)務平臺,完善招標控制價、合同價、結算價電子化備案管理(li),確保資(zi)金投資(zi)效益。
(二)開(kai)展工程(cheng)造價信息監測。
各級造(zao)(zao)價(jia)(jia)管理機構(gou)要加(jia)強工(gong)程(cheng)造(zao)(zao)價(jia)(jia)咨(zi)(zi)詢服務(wu)監督,指(zhi)導工(gong)程(cheng)造(zao)(zao)價(jia)(jia)咨(zi)(zi)詢企業對(dui)工(gong)程(cheng)造(zao)(zao)價(jia)(jia)成果數(shu)據歸集、監測,利用信息(xi)化(hua)手段逐(zhu)步實現對(dui)工(gong)程(cheng)造(zao)(zao)價(jia)(jia)的(de)監測,形成監測大數(shu)據,為各方主體計(ji)價(jia)(jia)提供服務(wu)。
(三)建(jian)立(li)工程造價監測指(zhi)數指(zhi)標。
各級工程造(zao)價(jia)管理機構要(yao)通過工程造(zao)價(jia)監測(ce),形(xing)成國家、省、市(shi)(shi)工程造(zao)價(jia)監測(ce)指(zhi)數指(zhi)標,定(ding)期發布造(zao)價(jia)指(zhi)標指(zhi)數,引導建設市(shi)(shi)場主體對價(jia)格變化進行研判,為工程建設市(shi)(shi)場的(de)預測(ce)預判等宏觀決策提供支持(chi)。
(四)規(gui)范計價軟件市場管(guan)理。
建立計(ji)(ji)價(jia)軟(ruan)件(jian)監督檢查機制。各級(ji)造價(jia)管(guan)理機構要定期(qi)開展計(ji)(ji)價(jia)軟(ruan)件(jian)評估檢查,加強計(ji)(ji)價(jia)依據和(he)相關標準規范執行監管(guan),鼓勵計(ji)(ji)價(jia)軟(ruan)件(jian)編制企(qi)業加大技術投入和(he)創(chuang)新,更(geng)好地服務工程計(ji)(ji)價(jia)。
