國務院:政府投資項目不得墊資建設!將對機關、事業單位追究責任!9月1日起施行!
為了(le)促進機關、事業單位(wei)和大型企(qi)業及時支付中小企(qi)業款項(xiang),維(wei)護中小企(qi)業合法權益,優化(hua)營商環境,國務院制(zhi)定了(le)《保障中小企(qi)業款項(xiang)支付條例》,自2020年(nian)9月1日起(qi)施行。
《條例(li)》規定(ding)政府(fu)投(tou)資(zi)(zi)項(xiang)目不得墊(dian)資(zi)(zi)建設,《條例(li)》共29條,主要(yao)包括三個方(fang)面內容:
1.規范合同訂立及資金保障 加強賬款支付源頭治理
《條例》規定,機關、事業單位和大型企業不得要求中小企業接受不合理的付款期限、方式、條件和違約責任等交易條件,不得違約拖(tuo)欠中小企業(ye)的貨(huo)物(wu)、工(gong)程、服務款項。同時,強化財政資金保障約束,機關、事業單位使用財政資金從中小企業采購貨物、工程、服務,應當嚴格按照批準的預算執行,不得無預算、超預算開展采購,政府投資項目所需資金應當按照國家有關規定確保落實到位,不(bu)得由(you)施工單位墊(dian)資建(jian)設。
2.規范支付行為,防范賬款拖欠
《條例》對付款期限和檢驗驗收提出了要求,明確禁止機關、事業單位和大型企業變相延長付款期限,規范保證金的收取和結算。同時,明(ming)確(que)機關、事業(ye)單位和大型企業(ye)遲延(yan)支(zhi)付中小企業(ye)款項應當支(zhi)付逾期利息,并對機關、事業單位在公務消費、辦公用房、經費安排等方面采取必要限制措施。
3.加強信用監督和服務保障
明確建(jian)立(li)支付信(xin)息披露制(zhi)(zhi)度(du)、投訴處(chu)理和(he)失信(xin)懲戒制(zhi)(zhi)度(du)以及監督(du)評價機制(zhi)(zhi),以維護中(zhong)小企業合法權益,營造良好營商(shang)環境。
墊資(zi)施工,是長期以來在我國建設工程施工領域存在的一種承(cheng)包方式。目(mu)前,我國的墊(dian)(dian)(dian)資施(shi)工(gong)(gong)(gong)主要(yao)有四種形式:一是全額墊(dian)(dian)(dian)資施(shi)工(gong)(gong)(gong),主要(yao)是指在工(gong)(gong)(gong)程(cheng)(cheng)建(jian)設過程(cheng)(cheng)中發包人(ren)(ren)(ren)不(bu)向(xiang)承包人(ren)(ren)(ren)支付(fu)(fu)任何工(gong)(gong)(gong)程(cheng)(cheng)價(jia)(jia)款,而要(yao)等待工(gong)(gong)(gong)程(cheng)(cheng)項目(mu)建(jian)設完畢經竣(jun)工(gong)(gong)(gong)驗收合格后,方按照約定支付(fu)(fu)工(gong)(gong)(gong)程(cheng)(cheng)價(jia)(jia)款;二是利(li)用(yong)工(gong)(gong)(gong)程(cheng)(cheng)進(jin)(jin)度款的不(bu)足額支付(fu)(fu),造(zao)成部分墊(dian)(dian)(dian)資施(shi)工(gong)(gong)(gong);三是要(yao)求承包人(ren)(ren)(ren)向(xiang)發包人(ren)(ren)(ren)支付(fu)(fu)保(bao)證(zheng)金作(zuo)為工(gong)(gong)(gong)程(cheng)(cheng)項目(mu)啟動資金,保(bao)證(zheng)金在施(shi)工(gong)(gong)(gong)過程(cheng)(cheng)中根據工(gong)(gong)(gong)程(cheng)(cheng)進(jin)(jin)度返還,造(zao)成部分墊(dian)(dian)(dian)資施(shi)工(gong)(gong)(gong);四是約定按照工(gong)(gong)(gong)程(cheng)(cheng)進(jin)(jin)度付(fu)(fu)款,比如約定基礎完成開始支付(fu)(fu)進(jin)(jin)度款,或結構封(feng)頂(ding)付(fu)(fu)至工(gong)(gong)(gong)程(cheng)(cheng)價(jia)(jia)款的一定比例(li)。
